<p><strong>Terms of Service of SZOM (Tamás Remetei, sole trader)</strong></p>

<p>These Terms of Service set out the rights and obligations of Tamás Remetei, sole trader (registered address: 8646 Balatonfenyves, Fenyvesi utca 139, Hungary; registration number: 55039790; tax number: 56400757-1-34) – hereinafter: the <strong>"Service Provider"</strong> – and the Consumer using the electronic commerce services available in the webshop operated by the Service Provider at www.szom.eu – hereinafter: the <strong>"Consumer"</strong>. (The Service Provider and the Consumer are hereinafter jointly referred to as the <strong>"Parties"</strong>.)</p>

<h3>2. General Provisions</h3>
<p>The "Webshop" means the platform available at www.szom.eu, which allows the Consumer to place orders for the products offered by the Service Provider (herbal-based tincture base blends and related products). Content published in the Webshop does not constitute a binding offer. The Service Provider confirms receipt of the Consumer's order by electronic means. If such confirmation is not received by the Consumer within 48 hours of sending the order, the Consumer shall no longer be bound by their offer.</p>
<p>The Service Provider reserves the right to refuse an order placed through the Webshop if it cannot be fulfilled due to the current stock situation. The Service Provider reserves the right to change prices for individual products, in particular with regard to ongoing promotions. The Service Provider notes that the automatic confirmation message sent by the Webshop does not constitute a signed, written contract, nor does it constitute acceptance by the Service Provider of a purchase offer made by the Consumer.</p>
<p>Points granted under the referral system (SZOM Coin points program) may only be redeemed in the Webshop in accordance with the point-redemption rules in effect at the time, and may not be combined with any other individually announced coupon discount, unless the Service Provider expressly provides otherwise in a separate announcement.</p>
<h3>3. Registration</h3>
<p>The primary purpose of registration is to make purchasing easier and to enable use of the points program and the referral (referrer) features. Before finalising an order, the Consumer may review the data provided, the contents of the cart, the shipping and payment method, and the shipping address. Data entry errors can be corrected on the Webshop interface before the order is submitted. Any data entry error noticed after the order has been submitted can be reported to the customer service e-mail address (info@szom.eu).</p>
<h3>4. Shipping and Payment Terms</h3>
<h4>a. Payment Information</h4>
<p>The Consumer may settle an order placed through the Webshop by one of the following methods:</p>
<ul>
<li><strong>Advance bank transfer within Hungary</strong> – the total amount of the order must be transferred to the bank account number indicated in the order confirmation e-mail and on the checkout "Complete" page, quoting the order number in the payment reference.</li>
<li><strong>Advance bank transfer from abroad</strong> – by transfer to the IBAN provided; international transfer fees may be charged by the Consumer's bank.</li>
<li><strong>Cash on delivery</strong> (where available for the selected shipping method) – paid upon receipt, to the courier or at the FoxPost parcel locker.</li>
</ul>
<p>The purchase price is, in every case, the consumer price indicated next to the ordered product, inclusive of VAT.</p>
<h4>b. Shipping Information</h4>
<p>The Service Provider delivers ordered products to the Consumer using the shipping method chosen by the Consumer (delivery to a FoxPost parcel locker, or another shipping method available at checkout). The delivery time is generally a few business days from the processing of the received order, which may be extended in individual cases; however, in the absence of explicit notice to the contrary, delivery will take place within a maximum of 30 days from the processing of the order.</p>
<p>Please only place an order if, at the time of collection (in the case of cash on delivery), you are able to pay the amount due. Any shipping and handling costs arising from parcels that are not collected and are therefore returned may be charged to the customer.</p>
<p>Upon receipt of the parcel, please check that it is undamaged. If the parcel is damaged, please notify us at info@szom.eu, documenting the damage with photographs where possible.</p>
<p>If the ordered goods are out of stock, or fulfilment of the order is not possible for objective reasons, the Service Provider is entitled to refuse the order, or to withdraw from a contract already concluded. In such a case, the Service Provider will refund, without delay, any amount already paid by the Consumer.</p>
<h3>5. Right of Withdrawal, Method, and Consequences</h3>
<p>In the case of a contract for the sale of goods, the Consumer is entitled to withdraw from the contract, without giving any reason, within 14 calendar days from the day on which the Consumer takes possession of the goods. (Government Decree 45/2014 (II. 26.), Section 20)</p>
<p>If the Consumer exercises their right of withdrawal, they must send their withdrawal statement to the Service Provider within the withdrawal period, to info@szom.eu. The right of withdrawal is deemed to have been exercised in due time if the Consumer sends the withdrawal statement before the 14-day deadline expires.</p>
<p>In the event of withdrawal, the Consumer must return the goods to the Service Provider's registered address (8646 Balatonfenyves, Fenyvesi utca 139, Hungary) at their own expense, within 14 days of communicating the withdrawal. The return deadline is deemed to have been met if the Consumer sends the goods before the 14-day deadline expires.</p>
<p>The Consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Given that the product is herbal-based and comes in packaging that, once opened, cannot be returned for hygiene reasons, the Service Provider is entitled – in accordance with applicable law – to refuse the exercise of the right of withdrawal in such cases, or to reduce the refund proportionately to reflect the condition of the product.</p>
<p>In the event of withdrawal, the Service Provider will refund the full amount paid by the Consumer, including the original delivery cost, except for any additional cost arising from the Consumer having chosen a shipping method other than the least expensive standard shipping method offered by the Service Provider. The direct cost of returning the goods shall be borne by the Consumer.</p>
<p>Parcels returned by cash-on-delivery cannot be accepted.</p>
<p>In the event of withdrawal, the Service Provider will refund the amount paid by the Consumer, as required by law, within 14 calendar days of becoming aware of the withdrawal. The Service Provider may withhold the refund until the goods have been returned, or until the Consumer has provided proof that the goods have been sent back. The refund will be made using the same payment method used by the Consumer for the original transaction, unless the Consumer expressly agrees to a different method; any such difference must not result in any additional cost to the Consumer.</p>
<p>If the Consumer believes that their rights have been infringed, they may lodge a complaint with the competent district office responsible for consumer protection in their place of residence, or with the Conciliation Board operating alongside the competent professional chamber in their place of residence or at the Service Provider's registered address.</p>

<h3>6. Warranty</h3>
<p>Any warranty claim can only be enforced upon presentation of the original invoice/confirmation, within 2 years of the purchase, if the defect arose from a cause already present at the time of purchase.</p>
<p>The relevant rules are set out in Act V of 2013 on the Civil Code, and in Government Decree 373/2021 (VI. 30.), which contains the detailed rules applicable to consumer sales contracts. Withdrawal is not available for insignificant defects. In the event of defective performance, the Consumer is entitled to the statutory warranty rights. The Consumer may primarily request repair or replacement, unless fulfilling the chosen request is impossible or would impose disproportionate additional costs on the Service Provider.</p>
<p>Any defect discovered within 12 months of performance shall be presumed to have already existed at the time of performance, unless the Service Provider proves that the cause of the defect arose after performance, for example due to improper use or storage of the product.</p>
<p>Please note that information on the intended use, storage, and recommended use of the product is provided with the product and/or in the product description available in the Webshop. The Consumer should take this information into account before using the product. The product is not a medicinal product and is not intended to diagnose, treat, or prevent any disease.</p>
<p>If a complaint regarding a returned and disputed product is found to be justified on the part of the consumer, the Service Provider undertakes to refund the purchase price in full, in accordance with applicable law, within 14 calendar days of the claim being determined to be justified.</p>
<h3>7. Legal Information and Other Provisions</h3>
<p>Matters not regulated by these Terms and Conditions shall be governed by the Civil Code, Government Decree 45/2014 (II. 26.) – which sets out the rules on information to be provided to consumers and certain rules of performance, as well as the detailed rules on the conclusion of distance contracts and the right of withdrawal or termination in the case of consumer contracts concluded at a distance – and Act CVIII of 2001 on certain issues of electronic commerce services and information society services.</p>
